This Privacy Policy describes how Ekway AI LLC (“Ekway AI,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards your personal information when you visit our website at https://ekwayai.com or use the Ekway AI platform (collectively, the “Service”). When you register for an account or create a workspace on the Ekway AI platform, we collect:

  • Full name and email address of the account holder and team members
  • Organization or business name
  • Password (stored as a secure, one-way cryptographic hash)
  • Billing address and payment information (processed by our payment provider; we do not store full card numbers)
  • Profile details and workspace configuration preferences
  • Communication channel credentials and API keys required to connect external services (e.g., WhatsApp Business API tokens, email provider settings)

1.2 Conversation and Communication Data

As part of providing our customer communication management service, we process:

  • Messages, conversations, and attachments exchanged through connected channels (Email, WhatsApp, Instagram, Facebook, Live Chat)
  • Contact information of your customers (names, phone numbers, email addresses) as entered or imported into the platform
  • Message metadata such as timestamps, delivery status, read receipts, and channel identifiers
  • Agent notes, internal comments, conversation tags, and resolution status
  • Canned responses, message templates, and campaign content you create within the platform

This data is processed on behalf of our customers (see Section 4 — Communication Data Handling).

1.3 Usage and Analytics Data

We automatically collect certain information when you access or use the Service:

  • Log data including IP address, browser type and version, operating system, referring URL, and pages visited
  • Device identifiers and hardware model information
  • Feature usage patterns, click events, and navigation flows within the application
  • Performance metrics such as page load times and error rates
  • Session duration and frequency of use

1.4 Cookies and Similar Technologies

We use cookies and similar tracking technologies to maintain sessions, remember preferences, and analyze usage. For more detail, see Section 7 (Cookies and Tracking Technologies) below.

  • Subscribe to our newsletter or waitlist

2. How We Use Your Information

We use the information we collect for the following purposes, relying on the legal bases indicated where applicable:

2.1 Providing and Operating the Service

We use your account and configuration data to create and maintain your workspace, authenticate users, route messages across connected channels, display conversation histories, and deliver core platform functionality. This processing is necessary to perform our contractual obligations to you.

2.2 Improving and Developing the Platform

Aggregated and anonymized usage analytics help us understand how users interact with Ekway AI, identify friction points, prioritize new features, fix bugs, and enhance performance. We do not use the content of your customer conversations for product improvement without explicit consent.

2.3 Billing and Payment Processing

We use billing information to process subscription payments, issue invoices, manage plan upgrades or downgrades, and address billing disputes. Payment processing is handled by PCI-DSS compliant third-party processors; we do not store full payment card details.

2.4 Communications and Support

We use your contact information to send transactional emails (account confirmations, password resets, billing receipts), important service announcements (security updates, policy changes, planned maintenance), and, where you have opted in, product newsletters and feature announcements. You may unsubscribe from marketing communications at any time.

2.5 Security and Fraud Prevention

We process IP addresses, login activity, and usage patterns to detect and prevent unauthorized access, abuse, spam, phishing, and other fraudulent or illegal activities. This processing is necessary for our legitimate interests in maintaining the integrity and security of the platform.

2.6 Legal Compliance

We may process personal data to comply with applicable laws and regulations, respond to lawful requests from government authorities, enforce our Terms of Service, or protect the rights, property, or safety of Ekway AI LLC, our customers, or the public.

3. Data Sharing and Disclosure

We do not sell, rent, or trade your personal information or your customers' data to third parties for their own marketing or commercial purposes. We share data only as described below:

3.1 Cloud Infrastructure and Hosting

Our platform is hosted on cloud infrastructure providers (including but not limited to major cloud platforms such as AWS, Google Cloud, or DigitalOcean). These providers act as data processors under our instruction and are bound by data processing agreements that prohibit unauthorized use of your data.

3.2 Payment Processing

Payment card data is handled entirely by our third-party payment processor(s) (such as Stripe). We share only the minimal billing information necessary (e.g., email address, subscription amount) with these providers. These processors are PCI-DSS compliant and operate under their own privacy policies.

3.3 Analytics and Monitoring

We use third-party analytics and error-monitoring services to measure platform performance and diagnose technical issues. These services receive limited telemetry data (such as anonymized usage events and stack traces) and are contractually restricted from using this data for purposes other than providing services to us.

3.4 Communication Channel Partners

When you connect third-party messaging channels (such as WhatsApp via Meta’s Business API, Instagram, or Facebook), messages are transmitted through those providers’ infrastructure. Your use of those integrations is additionally governed by the terms and privacy policies of those providers.

3.5 Business Transfers

If Ekway AI LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on our website prior to any such transfer and provide you with choices regarding your data.

3.6 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal process (such as a subpoena, court order, or government demand). We will attempt to notify you of such disclosure where legally permitted and practicable.

3.7 With Your Consent

We may share information with third parties when you have given us explicit consent to do so, such as when integrating an optional third-party application from our marketplace.

4. Communication Data Handling

Ekway AI is a customer communication management platform. In the course of providing the Service, we process messages, contacts, and related data on behalf of our business customers (“Customer Data”). In respect of this Customer Data:

  • Our customers are the data controllers. The businesses and individuals who subscribe to Ekway AI determine the purposes and means of processing their end-users’ (their customers’) communication data. Ekway AI LLC acts solely as a data processor in relation to Customer Data.
  • Customers own their data. Customer Data remains the property of our customers at all times. We process it exclusively according to our customers’ documented instructions as set out in our Terms of Service and any applicable Data Processing Agreement (“DPA”).
  • We do not use Customer Data for our own purposes. We do not analyze, mine, or use Customer Data (including the content of messages or end-user contact information) to build advertising profiles, train AI models without explicit authorization, or for any purpose other than delivering and improving the Service.
  • Access controls. Access to Customer Data by our employees and contractors is limited to personnel who require access to perform their job duties and is subject to confidentiality obligations.
  • Data Processing Agreements. Enterprise customers requiring a formal DPA (e.g., for GDPR compliance) may request one by contacting info@ekwayai.com.

5. Data Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, resolve disputes, and enforce our agreements.

Upon account closure, you may request the export of your data before deletion by contacting us at info@ekwayai.com. Data export will be made available for up to 30 days following account closure.

6. Your Rights

Depending on your jurisdiction, you may have the following rights with respect to your personal information. We honor these rights regardless of where you are located.

You may request a copy of the personal information we hold about you, along with information about how we use it.

You may request that we correct inaccurate or incomplete personal information about you. You can update most account information directly within your account settings.

You may request deletion of your personal information. We will honor such requests subject to legal retention obligations (e.g., financial records) and our legitimate interests (e.g., fraud prevention).

You may object to processing of your personal information for direct marketing purposes at any time. You may also object to processing based on our legitimate interests, and we will cease such processing unless we have compelling overriding grounds.

In certain circumstances, you may request that we limit the processing of your data (for example, while a dispute about accuracy is resolved).

GDPR (EU/EEA residents): You have the rights listed above under the General Data Protection Regulation. You also have the right to lodge a complaint with your local supervisory authority.

CCPA/CPRA (California residents): You have the right to know, delete, correct, and opt out of the “sale” or “sharing” of personal information. We do not sell or share your personal information as defined under California law.

We use cookies (small text files stored in your browser) and similar technologies (such as local storage and session storage) to operate and improve the Service. The categories of cookies we use are:

Essential Cookies Always Active

These cookies are strictly necessary for the Service to function. They enable core functionality such as session management, authentication, security (CSRF protection), and workspace context. The Service cannot function properly without these cookies, and they cannot be disabled.

Preference Cookies

These cookies allow us to remember your preferences and settings, such as your chosen color theme (light or dark mode), language preferences, and UI layout configurations, so you do not have to reconfigure them on each visit.

Analytics Cookies

We may use analytics cookies to collect information about how visitors use our website, which pages are visited most often, and how users navigate through the application. This information is used in aggregate to improve our website and platform. Where we use third-party analytics tools, they are configured to anonymize IP addresses and are prohibited from using collected data for their own purposes.

8. International Data Transfers

Ekway AI LLC is based in the United States. Where we transfer personal data from the European Economic Area (“EEA”), the United Kingdom, or Switzerland to a country not deemed adequate by the relevant authorities, we rely on appropriate safeguards such as Standard Contractual Clauses (“SCCs”) approved by the European Commission, or other lawful transfer mechanisms.

9. Children’s Privacy

The Ekway AI platform is intended solely for use by business professionals and is not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16. If you are under 16, please do not use the Service or provide any personal information.

If we become aware that we have inadvertently collected personal information from a child under 16 without verifiable parental consent, we will take steps to delete that information promptly. 10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make material changes, we will notify you by:

  • Displaying a prominent notice on our website or within the application
  • Updating the “Effective Date” at the top of this page
